Schertz was charged with obtaining money by false pretenses, a felony. She was convicted of one count of conspiracy to obtain money by false pretenses pursuant to plea negotiations. Law Offices of Roderic Carucci was retained to pursue an appeal. The Supreme Court held as follows: “Under these specific and undisputed facts, we conclude that there was no basis for prosecution of Schertz. Accordingly, the judgment of conviction entered by the district court is vacated and the information is dismissed.”
